Voluntary Consent to the storage and processing of personal data in the Career Pool
With this form, we request your consent to the processing of personal data in the Career Pool. Below follows a description of what your consent to the processing of your personal data entails.
1. Career Pool
You can agree to be potentially included in our Career Pool for a possible contact after the application process, following an event or outside of a specific vacancy. In the event of an application, your data will be stored for a regular period of six months after completion of the application process, and for two years if you receive an employment contract. If we confirm your inclusion in the d-fine* Career Pool, your data will remain in the Career Pool until withdrawn by you. If you give your consent to be included in the Career Pool as part of your application process, d fine will make the decision on your inclusion in the Career Pool at the end of the application process.
2. Controller
Controller as defined by the General Data Protection Regulation (GDPR) is the group’s holding company d fine GmbH, An der Hauptwache 7, 60313 Frankfurt/Main, Germany, phone: +49 69 90737-0, email: info@d-fine.com (“d-fine”, “Controller”, “we”, “us”). We share your personal data with our affiliates.
3. Purposes; Legal basis of processing
We process your personal data to assess and complete your registration in the Career Pool. When included in the Career Pool, we use your personal data to contact you, for example, to (re-)include you in the application process, to invite you to events and to send you newsletters (in which we inform you, for example, about events, new job advertisements and general news about d-fine). We may also (re-)evaluate your application in relation to any position that may be opened in the future. The legal basis for processing is consent of the data subject, pursuant to Article 6 Para 1. a) GDPR.
4. Provision of data; Automated decision-making
There is no legal or contractual obligation to provide your data. However, the provision of your data is necessary for the application and hiring process, including matching your qualifications with job requirements, selecting event participants, and initiating onboarding or event organization. It is also required to assess your inclusion in the Career Pool.
Automated decision-making, e. g. profiling and automated evaluation does not take place.
5. Recipients; Transfer of personal data
Access to your personal data is granted to employees of the human resources department of d-fine. Furthermore, individually selected employees, managers and executives are granted access in the context of the application process as well as the project staffing process (applicable to consulting applicants only).
The access rights to your personal data are assigned by the human resources department exclusively to the necessary group of people and only for the necessary period of time.
This includes employees or collaborators of parent, subsidiary, or associated companies.
The travel expenses and controlling department may process specific necessary data, for example, in the case of travel expense reimbursements. Certain necessary data may be transferred to service providers, if required, for example, for travel reservations or event organization.
Your data is processed in Germany as well as the country of the position or event for which you applied (within the European Economic Area or in Switzerland and UK).
In the event that some of the above-mentioned subjects are based outside the European Economic Area (e. g. group companies located in Switzerland and UK), we may transfer your personal data pursuant to the relevant adequacy decision of the European Commission, under article 45 of the GDPR or, in the absence of an adequacy decision and without any of the exceptions set out in Article 49 of the GDPR, on the basis of the standard contractual clauses set out in Article 46 c. 2(c) and (d) of the GDPR. An adequacy decision made by the European Commission concerning the processing of data within Switzerland (d-fine AG) and the United Kingdom (d-fine Ltd) is provided.
All data is stored on the servers of our IT-provider d.vinci HR-Systems GmbH in Hamburg (Germany).
6. Duration of storage; Deletion
Your consent is valid until further notice. You have the right to withdraw your consent at any time. Your personal data will remain in the Career Pool until withdrawn by you. In the event of withdrawal or deregistration from the Career Pool, your data will be deleted immediately. In the case of an application, however, your data stored in the recruitment system will be deleted no earlier than six months after completion of the application process (analogous to the deletion periods according to the data protection notice for the application process).
7. Voluntariness; Withdrawal
This consent is voluntary and has no impact on the course of any application procedure. You may refuse to give your consent without providing any reasons and without any disadvantages. You can withdraw your consent at any time. To withdraw your consent, please send an email to careers@d-fine.com or follow the unsubscribe notice directly in the Career Pool emails. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of the consent before its withdrawal.
8. Your Rights in relation to your personal data
As a data subject, you have various rights under the GDPR, which are particularly outlined in Articles 15 to 21 of the GDPR:
- be informed of the purposes and methods of the processing of your personal data.
- access your data; You have the right to request confirmation as to whether relevant data is being processed, as well as access to this data, along with further information and a copy of the data in accordance with the statutory provisions.
- rectification of incomplete, inaccurate or outdated data; You have the right, in accordance with the statutory provisions, to the completion of incomplete data and to the rectification of inaccurate information concerning you.
- erasure of your data; You have the right, in accordance with the statutory provisions, to the erasure of data concerning you. This enables you to ask us to delete or remove personal data.
- restriction of processing; This enables you, in accordance with the statutory provisions, to ask us to suspend the processing of personal data about you.
- objecting, in cases provided for by law, in whole or in part, to the processing of data.
- data portability of your personal data, if technically feasible; You have the right, in accordance with the statutory provisions, to receive the data concerning you that you have provided or to transfer those data to another controller.
- lodging a complaint with a supervisory authority.
- Sweden: You have the right to lodge a complaint to Integritetsskyddsmyndigheten – the Swedish Authority for Privacy Protection (www.imy.se).
- Right to withdraw consent: If you have given consent regarding the processing of your personal data you may withdraw this consent at any time. The legitimacy of the processing before withdrawal remains unaffected.
